Terms and Conditions

These Terms and Conditions (“Terms”) govern your use of FoxWapp (“FoxWapp”, “we”, “us”), operated by DN Info Solution. By creating an account or using FoxWapp, you agree to these Terms. If you do not agree, do not use the service.

1. About FoxWapp

FoxWapp is a Tech Provider that enables businesses to connect their own WhatsApp Business Account (WABA) to the official WhatsApp Business Platform (Meta Cloud API) for marketing, CRM, automation, and customer communication.

2. Ownership of Your WhatsApp Account

We do not own your WhatsApp number or your WhatsApp Business Account. Ownership and control of your WABA and phone number remain with you inside your own Meta Business Manager at all times. FoxWapp acts only as an authorized partner to operate messaging on your behalf.

3. Eligibility & Account

You must be at least 18 years old and authorized to act for your business. You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account.

4. Fees

• Meta / WhatsApp fees: WhatsApp conversation and messaging charges are billed directly by Meta to your WhatsApp/Meta account. FoxWapp does not control these charges.
• Platform fee: FoxWapp charges its own platform/subscription fee for use of the software. Platform fees are separate from Meta’s charges.

5. Acceptable Use

• No spam, unsolicited messaging, or sending without valid recipient opt-in/consent.
• No illegal, fraudulent, abusive, or policy-violating content.
• You must comply with the WhatsApp Business Messaging Policy, WhatsApp Commerce Policy, and the Meta Platform Terms.
• You are solely responsible for the content you send and for obtaining lawful consent from your contacts.

6. Your Responsibilities

You are responsible for the accuracy of the data you upload, for complying with applicable laws (including data protection and anti-spam laws), and for the messaging you initiate through the platform.

7. Removing Access

You may remove FoxWapp’s access to your WhatsApp Business Account at any time from your Meta Business Settings → Partners. Doing so will stop FoxWapp from sending or managing messages on your behalf.

8. Suspension & Termination

We may suspend or terminate access for violation of these Terms, Meta’s policies, non-payment, or to protect the platform and its users. You may stop using the service at any time.

9. Service Provided “As Is”

FoxWapp is provided on an “as is” and “as available” basis without warranties of any kind. We do not guarantee uninterrupted or error-free operation, nor message deliverability, which depends on Meta and the recipient.

10. Limitation of Liability

To the maximum extent permitted by law, FoxWapp and DN Info Solution shall not be liable for any indirect, incidental, or consequential damages, or for charges levied by Meta, arising from your use of the service.

11. Indemnification

You agree to indemnify and hold harmless FoxWapp and DN Info Solution from claims arising out of your use of the service, your content, or your violation of these Terms or applicable law.

12. Third-Party Services

FoxWapp relies on Meta’s WhatsApp Business Platform. Your use of WhatsApp is also subject to Meta’s and WhatsApp’s own terms and policies, which you must comply with.

13. Changes to These Terms

We may update these Terms from time to time. Continued use after changes constitutes acceptance of the updated Terms.

14. Governing Law

These Terms are governed by the laws of India, without regard to conflict-of-law principles.
